Terms of Service

These terms govern the contracting of MencionIA's paid plans. The legal notice and the privacy policy also apply and form part of the agreement.

Who provides the service

MencionIA is owned by Antonio Samuel Martín Polo (Autonomio), Spanish tax ID (NIF) 50555557Q. Contact email: hola@mencionia.es. All support is provided in writing to that address.

What you are contracting

MencionIA measures whether AI assistants (ChatGPT, Gemini, Perplexity and Claude) mention your brand when someone asks about your category, and writes the content you're missing for the questions you lose. Each plan includes specific monthly limits:

  • Free check: 1 brand, 1 scan a month of 6 questions, no written Answers.
  • Business ($29/month): 1 brand, 5 Answers a month, 8 scans of 12 questions, automatic re-scan every 30 days.
  • Pro ($79/month): 3 brands, 20 Answers a month, 30 scans of 16 questions, re-scan every 15 days, API and MCP server access, and a PDF report.
  • Agency ($149/month): 10 brands, 60 Answers a month, 100 scans, plus white label on the report and the dashboard.
  • Agency 30 ($299/month): 30 brands, 150 Answers a month, 300 scans, with white label.

Monthly counters reset to zero on the 1st of each month and don't carry over. If you hit a limit, the service tells you and you can change plans at any time.

Pricing, taxes and billing

The prices shown above are for the English version of MencionIA and are listed and billed in US dollars (USD), not euros. Depending on where you and your business are located, taxes may apply on top of the listed price. That is why the payment form asks for a billing address and a tax identification number.

Billing is monthly, in advance, and renews automatically until you cancel. Payments are processed by Stripe, which handles your card details directly: MencionIA never stores your card information at any point. Stripe issues the invoice for each charge.

How to cancel

You can cancel whenever you want, with no minimum term and no penalty, by writing to hola@mencionia.es or from Stripe's customer portal. Cancellation takes effect at the end of the period you've already paid for: you keep the plan and its limits until that date, after which the account moves to the free plan. Months already billed are not prorated or refunded.

Your account and your analysis history remain yours. If you want us to delete your data, ask by email and it will be done, as detailed in the privacy policy.

Right of withdrawal

MencionIA is aimed at businesses and professionals, and in that case there is no statutory right of withdrawal, because that right is reserved by law for consumers.

If you are contracting as a consumer, you have 14 calendar days to withdraw. However, by contracting you expressly request that the service starts immediately, and you acknowledge that once it has been fully performed within that period, you lose the right of withdrawal, as set out in article 103.a of the Spanish Royal Legislative Decree 1/2007. In practice: if you have already run analyses or generated Answers, that part is consumed. To exercise the right of withdrawal, simply email hola@mencionia.es.

What we guarantee and what we don't

This matters, so we say it plainly. MencionIA does not guarantee that you will appear in any AI assistant's answers, in what position, or within what timeframe. No one can guarantee that: those systems belong to third parties, they change their models and sources without notice, and the same question can return different answers on two consecutive days.

What we do guarantee is the work: that the questions are actually run against the engines, that what is measured is what is shown, and that the content is written from that measurement. The figures in the reports are a trend and comparison measurement, not an absolute truth, and should be read as such.

When an engine fails or doesn't answer, that question is marked as not measured and left out of the calculation, instead of being counted as if your brand hadn't appeared.

The content we write

The Answers that MencionIA generates are yours: you can publish, edit or discard them without asking permission or citing the source. They are written with the help of language models based on data from your own website and the measured answers, so review them before publishing. You decide what goes on your site and you are responsible for what you publish there, including making sure any data, prices or claims about your business are correct.

Acceptable use

By using the service you agree to:

  • Only analyze brands and domains you are entitled to, whether they are your own or a client's who has commissioned you to do so. The agency plans exist precisely for that.
  • Not resell or redistribute access to the service beyond what your plan allows.
  • Not try to bypass the plan limits, whether through multiple accounts or automated requests outside the API.
  • Not use the service for anything unlawful or to impersonate another brand.

Each analysis consumes paid calls to third-party models, so automatic safeguards exist against abuse. If we detect usage outside these terms, we'll warn you by email first; if it continues, we may suspend the account and refund the unused part of the current month.

The WordPress plugin and the token

MencionIA's WordPress plugin works by pulling from the service, never the other way around: your site requests pending content and creates it locally. MencionIA never receives any credential from your WordPress site, no username or application password. The only thing you paste into your site is a read token for your own account, which is used to read your Answers and mark them as published, and nothing else.

That token identifies your account: keep it like you would a password. You can revoke it at any time from your profile, and doing so cuts off the plugin's access instantly.

Availability

MencionIA is provided as-is, with no contracted uptime commitment. We make reasonable efforts to keep it running, but it depends on third-party services (the AI engines, hosting, the payment gateway) that can fail. If an outage prevents you from using the service for a significant period, contact us and we'll compensate you with extra subscription time.

Personal data

How we handle personal data is explained in the privacy policy. In short: we process the data needed to provide the service and to bill you, we don't sell it to anyone, and reports are generated from publicly available website data.

Changes to these terms

These terms may change. If a change materially affects you, for example a price increase or a reduction in your plan's limits, we'll notify you by email at least 30 days in advance and you can cancel before it takes effect. Minor changes are published here with their update date.

Governing law

These terms are governed by Spanish law. For any dispute, the parties submit to whichever courts have jurisdiction under that law. If you are contracting as a consumer, you retain the right to bring proceedings before the courts of your own domicile.
